A combination of social forces has thrown marriage into question in westernised societies at the end of the millennium. This uncertainty creates space for new ways of thinking about marriage. In this context, we examine the idea of marriage as friendship. We trace its genealogy in the work of Mary Wollstonecraft, John Stuart Mill and Harriet Taylor and then subject it to critical scrutiny using some of Michel de Montaigne’s ideas. We ask how applicable the ideal of higher friendship is (...) to marriage and what might be gained and lost by a synthesis of marriage and friendship. Grounding the discussion in historical sources is valuable because the topic is so little explored in the contemporary philosophical literature. This approach also allows any enduring value in these historical texts to be elicited. (shrink)

Our aim in this paper is to bring the woefully neglected literature on predictive modeling to bear on some central questions in the philosophy of science. The lesson of this literature is straightforward: For a very wide range of prediction problems, statistical prediction rules (SPRs), often rules that are very easy to implement, make predictions than are as reliable as, and typically more reliable than, human experts. We will argue that the success of SPRs forces us to reconsider our views (...) about what is involved in understanding, explanation, good reasoning, and about how we ought to do philosophy of science. Il est une question fondamentale dont il semble pourtant qu’elle n’ait pas été posée: celle de savoir ce qui fait que le cogito soit effectivement un principe métaphysique, c’est-à-dire une vérité première. Il semble aussi que ce qui d’ordinaire tient lieu de réponse à cette question dans l’esprit des lecteurs de Descartes, c’est le sentiment vague qu’il s’agit là de la première vérité qui surgisse après la dévastation laissée par le doute universel de la Première Méditation, ou peut-être qui surgisse (...) au cœur de ce doute, puisque le doute ne s’autodétruit que pour faire place à ego sumOr s’en tenir à cela pour justifier le statut de principe métaphysique du cogito, c’est confondre priorité chronologique et primauté métaphysique ou épistémique: en effet, qu’y aurait-il dans le seul fait de se présenter ainsi qui assure que le cogito doive fonder d’autres connaissances, d’éventuelles sciences? Qu’est-ce qui empêcherait aussi qu’il ne soit lui-même assujetti à d’autres connaissances, plus fondamentales, et dont le méditant ne se serait peut-être pas encore aperçu? Il est vrai que cette confusion est compréhensible, puisque la primauté métaphysique du cogito coïncide effectivement avec sa priorité dans l’ordre des connaissancesMais dans le doute ambiant, celle-ci n’est en réalité qu’un effet de celle-là, et le simple fait de constater l’une ne revient pas à être assuré de l’autre. ‘All the difficulties in the theory of forms arise from their separation.’ This recurrent criticism of Aristotle's is, of course, one of the principal obstacles in the way of any reconstruction of the Platonic metaphysic. To begin with, it is flatly denied by Plato himself in the use of such words as μέθεξις, παρoυσία and κoινωνία. It must also be rejected by the orthodox account of the Forms which takes them to be immanent, constitutive principles in the world of everyday (...) life, like a Law of Nature or the Concrete Universal of Hegel. Finally, modern philosophy has made it clear that this view of universals is right and necessary if thought and language are to exist, and it is therefore tempting to attribute it to Plato. (shrink)

Background and objectives Conscientious refusal of abortion has been discussed widely by medical ethicists but little information on practitioners' opinions exists. The American College of Obstetricians and Gynecologists (ACOG) issued recommendations about conscientious refusal. We used a vignette experiment to examine obstetrician-gynecologists' (OB/GYN) support for the recommendations. Design A national survey of OB/GYN physicians contained a vignette experiment in which an OB/GYN doctor refused a requested elective abortion. The vignette varied two issues recently addressed by the ACOG ethics committee—whether the (...) doctor referred and whether the doctor disclosed their objection to the abortion. Participants and setting 1800 OB/GYN randomly selected physicians were asked to complete a mail survey containing the vignette. The response rate was 66% (n=1154) after excluding 40 ineligible cases. Measurement Physicians indicated their approval for the vignette doctor's decision. Main results Overall, 43% of OB/GYN physicians responded that the conscientious refusal exercised by the vignette physician was appropriate. 70% rated the vignette doctor as acting appropriately when a referral was made. This dropped to 51% when the doctor disclosed objections to the patient, and to 12% when the doctor disclosed objections and refused to make a referral. Consistent with previous research, males were more likely to support disclosure and refusal to refer. Highly religious physicians supported non-referral but not disclosure. Conclusion OB/GYN physicians are less likely to support conscientious refusal of abortion if physicians disclose their objections to patients. This is at odds with ACOG recommendations and with some models of the doctor–patient relationship. (shrink)

The European Clinical Trials Directive was issued in 2001 and aimed to simplify and harmonise the regulatory framework of clinical trials throughout Europe, thus stimulating European research. However, significant complexity and inconsistency remains due to disparate interpretation by EU member states. Critical care research has been particularly impacted due to variable and often restrictive consenting procedures for incapacitated subjects, with some countries requiring a court-appointed representative, while others recognise consent from family members and occasionally professional representatives. Furthermore, the absence of (...) a waiver of consent threatened to put an end to emergency research in Europe and was met with varied responses. Approval procedures by ethics committees are equally inconsistent, particularly those relating to provision of a single opinion for multi-centre trials. Although evidence is somewhat mixed, this complexity as well as a general increase in administrative and financial burden following the Directive has been shown to cause a reduction in clinical trial activity in Europe, particularly academic trials. We aim to clarify some of these inconsistent procedures, particularly those relating to informed consent of incapacitated subjects, as well as discussing some general weaknesses and possible improvements of the Directive ahead of its planned revision in 2011. Some philosophers suspect that the functionalist account of mind supports a psychologistic account of logic. One who has argued for a connection of this kind is Remmel T. Nunn. If the connection holds, it might be a powerful support for the currently unfashionable position of psychologism; conversely, it might be a damaging objection to functionalism. In either case, to estabjish the connection would be an achievement of considerable philosophic interest.
